SlideDeck Terms and Conditions

SlideDeck® (in any version) is a registered trademark of digital-telepathy. The software is available in multiple forms: the SlideDeck WordPress Plugin and the SlideDeck JavaScript (.js) Library.

By purchasing SlideDeck, you agree to all of the Terms and Conditions. If you do not agree, please do not purchase and/or use SlideDeck.

1. License

SlideDeck is licensed under the GNU Public License version 3 (GPLv3). Specific information about the GPL can be found here: http://www.gnu.org/licenses/gpl.html.

2. Our Trademarks

SlideDeck, SlideDeck 2, SlideDeck for WordPress, SlideDeck jQuery, SlideDeck.js, and SlideDeck Developer Kit are all trademarks of digital-telepathy. These trademarks may not be used in any manner without express written permission from digital-telepathy.

3. Support and Upgrade Subscription

Technical support and software upgrades are provided electronically only (via the support forum only, no telephone support) to customers who have an active support and upgrade subscription for the version of SlideDeck they have purchased. Support and upgrades will be provided in accordance with the following parameters for a period of one (1) year from the date of purchase or renewal.

Your support and upgrade subscription is linked to your license key, which is issued to you (and only you) at the time of purchase. You agree that you will not sell, share or otherwise distribute your license key with anyone; doing so will result in an immediate cancellation of your support and upgrade subscription. We reserve the right to modify or terminate your support and upgrade subscription at any time if we determine that you have violated these Terms and Conditions.

4. SlideDeck License Upgrades

At any time, you have the opportunity to upgrade your license by purchasing a higher tier at a discount. Higher tiers allow for additional features as well as concurrent supported installations of SlideDeck (as defined in these Terms and Conditions). Here are some potential upgrade paths:

To upgrade, simply log in to your account and click on the Upgrade link. The license pricing will reflect your upgrade discount. The renewal date for your support and upgrade subscription will be adjusted to your most current purchase date.

5. Getting Your Software (Delivery)

After your payment has been successfully processed, you will receive an email with instructions to download the SlideDeck software. This email should show up immediately, but can take up to an hour. If you don’t hear from us in an hour, please contact us. Once you have your email, follow the instructions provided to log in to your account and download your software.

6. Emails and Using the Right Email Address

Please make sure that you use the e-mail address that you purchased with for all communications. We manage your account by this address only, and won’t be able to locate your purchase if you switch to a new address. We may occasionally send you emails regarding information about SlideDeck or other products from digital-telepathy. We promise to never sell or share our lists with anyone outside of our company. You can unsubscribe from these emails at anytime via the unsubscribe link in the footer of the email.

7. Content and Content Providers

SlideDeck allows you (and your users) to view, access, review and display content from a variety of content providers. digital-telepathy has no: liability for, association with or control over any content or content provider. By using SlideDeck, you understand and agree that you are solely responsible for the content and its availability (or lack thereof).

8. Browser and Platform Requirements

SlideDeck 2 requires WordPress version 3.3 or newer, jQuery 1.7.1, and a modern browser. Currently our supported browsers are Safari 4.0 and newer, Firefox 3.6 and newer, Google Chrome, and Internet Explorer (IE) versions 8 and newer. SlideDeck .js requires jQuery 1.3+

9. Refunds

Since SlideDeck is a non-tangible digital good, we do not generally offer refunds. By purchasing SlideDeck, you agree to these terms. We may consider a refund for the SlideDeck WordPress Plugin, provided that all the following criteria have been met:

No refunds will be issued more than fourteen (14) days after purchase of the SlideDeck WordPress Plugin. No refunds will be issued at any time for SlideDeck jQuery (.js).

10. Price Changes

digital-telepathy reserves to change the price of SlideDeck (any version) at any time. Any price change will be reflected on the website. In the event that any price is lowered, you will not be entitled to a refund in the difference in the price from the time you purchased SlideDeck.

11. Ownership and Warranty

SlideDeck (both the WordPress and .js versions) are the intellectual property of digital-telepathy. You may not claim exclusive ownership to any of our products.

SlideDeck has been created with care. We have put SlideDeck through rigorous testing, and only release proven, stable versions of the software. Due to the dynamic nature of WordPress and the many plugin configurations that are available, it is impossible to test every possible combination of SlideDeck, WordPress and any other plugins you may have installed. If you find a bug, please open a support ticket, and we will do our best to resolve it.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE USE OF THE SLIDEDECK SOFTWARE IS AT YOUR SOLE RISK AND THAT RISK IS ACCEPTABLE TO YOU. THE SOFTWARE IS PROVIDED “AS IS,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DIGITAL-TELEPATHY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SLIDEDECK SOFTWARE, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. DT DOES NOT WARRANT THAT THE SLIDEDECK SOFTWARE WILL MEET YOUR REQUIREMENTS, WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE SOFTWARE WILL BE COMPATIBLE WITH OTHER THIRD PARTY SOFTWARE, SERVERS OR PLATFORMS. THIS DISCLAIMER CONSTITUTES AN ESSENTIAL PART OF THESE TERMS AND CONDITIONS. THESE TERMS AND CONDITIONS SUPERSEDE ALL CLAIMS MADE ORALLY OR IN WRITING OUTSIDE OF THESE TERMS AND CONDITIONS.

12. Right to Refuse Service

We are friendly, professional people, and expect you to be the same. Please always be kind and courteous to any of our staff and members of the community. We will not tolerate abusive or offensive behavior of any kind. We reserve the right to stop providing service to you and terminate your support and upgrade license at any time, for any reason. Please don’t be a jerk.
